Ruling on One Losing his Shoes and Finding Another Pair in Its Place – Shaikh Ibn ul-Uthaymeen

Question: What is the ruling on the one who finds in the place of his shoes, the shoes of another. Should he take and wear them or leave them?

Answer: “He leaves it and it is not allowed for him to take it because it is possible his shoes were taken by someone other than the owner of these shoes, so he takes what is not his. Yes some scholars said: if the shoes are similar, I mean, his shoes and the shoes that are remaining, then there is no harm here in taking it. This is because the apparent situation was that the owner of the shoes was mistaken and took his shoes (i.e. the shoes of the other man) thinking it to be his.

No doubt this statement has a point, however, piousness is to not do so. He should consider them a lost item, if he wants he takes them and announces and if he wants he leaves them”.
